This page explains why we hold information about you and who is responsible for the information.

Data Controller

The Data Controller of the information being collected is Clackmannanshire Council.

  • Business improvement District Levy
  • Housing benefits
  • Scottish welfare fund
  • Sundry debts

  • The performance of a public task that is carried out in the public interest or
  • in the exercise of official authority vested in the data controller as per Article 6(1) (e) of the UK GDPR and the task or function has a clear basis in law.

What personal data we will collect from you

We will only collect the personal information we need to provide you with relevant information and services as above. The personal data we will collect may include:

  • Name(s) of all occupants of the household
  • Name of property owner(s)
  • Address
  • Date of birth
  • National insurance number
  • Income details
  • Telephone number (landline and mobile)
  • Email for you and any partner
  • Bank Account Details
  • Health conditions (where relevant)

Information sharing

Your information may/will be shared with the following:

For Council Tax or Non-domestic Rates and/or reliefs for these services:

  • Our third-party supplier (who process your data on our behalf by printing and issuing your bill to you)
  • Other Council departments (as the law allows)
  • Other Local Authorities (as the law allows)
  • Government Agencies (for the prevention of crime and fraud)
  • Central Scotland Valuation Joint Board
  • Scottish Government and related agencies
  • UK Government and departments (verification of entitlement to Energy Bill support schemes)
  • Sheriff Court Administration and
  • Debt Recovery, Tracing agents and/or Sheriff Officers (if Court action for recovery of debt is necessary)
  • Business Improvement District companies
  • IT system support internal and external

We will not share any health related data you provide to us with anyone.

Retention

Purpose we collect your personal data and the retention period for the data is detailed below:

  • Council tax collection: Current year + 20 years
  • Collection of non-domestic rates payable for a property: Current year + 20 years
  • Records documenting the administration of Council Tax and Non-domestic Rates: 6 years (from end of financial year)
  • Debt management records - debts owed to the Council: 6 years (from end of financial year)

Data subject rights

Please note that the lawful basis for processing/using your personal data directly impacts which rights are available to you. Some rights will not apply if we are processing your data under public task we are not required to:

  • erase your personal information;
  • enable the right to data portability.

However, you do have the following rights and can ask us to:

  • correct your personal information if it is inaccurate;
  • complete your personal information if it is incomplete; and
  • restrict the processing of your personal information in certain circumstances.

You also have the right to object to the processing of your personal information and the right to access your information.

Failure to provide personal information

Where the provision of your information to the Council is a statutory or contractual requirement, or a requirement necessary to enter into a contract, you are obliged to provide the information. If you fail to provide this information you may be subject to civil penalty notices and we will not be able to process any applications for reliefs.

Right to complain

If you are unhappy with the way the Council has processed your personal data you have the right to complain. Any complaints regarding your data should be addressed to the Data Protection Officer.
