Roads Development Control

Transportation is an integral component of the development planning system and the Roads Development Control process provides the opportunity for the transportation components of each development to achieve the required standard in terms of road safety, user amenity, quality 'place making' (as advocated by the national design policy document 'Designing Streets') and sustainability. These elements, together with an emphasis on accessibility for all development users, are principal driving factors when the Section considers new development proposals. Roads Development Control is also the process undertaken to advise and liaise with all parties involved in each proposed development to attain high standards of road, footway, cycleway and public transport access.

The national design document 'Designing Streets' has now been adopted as national policy and the sets out the ethos for street design in Scotland. Clackmannanshire Council remains a strong advocate of the approach this guidance recommends. The Society of Chief Officers of Transportation for Scotland (SCOTS) has developed the National Roads Development Guide which incorporates the ethos of 'Designing Streets'.

If you are required to construct a new road, part of a new road, or a new footway or footpath, you must apply for a Construction Consent from the Council. A copy of the application form is available for download below. In terms of Construction Consent applications, 'Designing Streets' suggests that, ideally, this technical application to the Council should occur in tandem with associated submissions for planning consent and this approach will, as far as practicable, be adopted by the Council. However, Construction Consent will not be approved without a necessary planning consent being in place.

If you require to excavate or change the existing public road or footway you must apply for a Minor Roadworks Consent from the Council. A copy of this form can be downloaded below.
