Permit Summary

If you wish to occupy the road or footway for the temporary deposition of a builder's skip, you require permission from the Roads Authority. This is a legal requirement under section 85 of the Roads (Scotland) Act 1984. The term "road" covers the carriageway, footway or verge of any road and includes public footpaths and cycle tracks.

Eligibility Criteria

Anyone can apply for a Skip Permit.

Application Process

Applications must be made using the approved application forms and must be accompanied by three copies of a plan or sketch showing the area on which the applicant intends to place the skip. Applications must be received at least 7 days in advance of any proposed occupation. Once received, the site will be examined and conditions of occupation attached to the permit. The applicant will be contacted directly about issues which are not clear from the completed application form.

Consent

Express consent is required from the Roads Authority for the occupation of the road or footway. No tacit consent will be permitted. If you have not heard from the Roads Authority within 7 days of the submission of your application, please contact the authority. Occupation of the road or footway without the written permission of the Roads Authority, is an offence. Skips placed without consent or contravening the terms of the permit or incorrectly located can be moved by the roads authority or the police and any costs incurred will be recharged to the applicant.

Permission refused

If permission for a Skip Permit is refused, you should contact the local authority directly if you are unhappy with the reasons given for the refusal.
