Enforcement of Planning Regulations

Clackmannanshire Council has a duty to regulate the development and use of land. The keystone of the planning system is the requirement to obtain planning permission for development. Where development has been carried out without the required permission, or has been carried out without complying with any condition or limitation required by the permission, a breach of planning control exists: the development is unauthorised.

Any action which the council may consider taking in relation to unauthorised development must be proportionate to the nature of the development and the sensitivity of the location. Decisions will be guided by the Development Plan Policy to assist in understanding the council's role in what can become a complex and sensitive subject, the council has provided a Planning Enforcement Charter. The Charter explains how we handle enquiries, the information that may be required, the investigation work to be carried out, and the factors to be taken into account in deciding whether to take formal action.

Decisions on formal action are entirely discretionary, but this charter combined with our working strategy will ensure a fair consistent and transparent approach to decision making.
