Duty of Care

What is your Duty of Care?

When you sign up as a commercial customer you must fill out a 'duty of care' controlled waste transfer note. This is a legal requirement for every waste transfer.

'Controlled Waste' in this context refers to commercial and industrial waste.

Please fill in the form we send you, send one copy back to the Council and retain one copy for your records. You will be asked to fill this form out annually and copies must be retained for two years.

On the form tick all the waste types that apply. If a waste type is not listed then remember to enter the details.

Why is this necessary?

As a business you have a 'duty of care' to ensure that all waste you produce is handled safely and within the law.

If you give waste to someone else, you must be sure they are authorised to take it and can transport, recycle or dispose of it safely at properly licensed sites.

The 'duty of care' form that you are asked to fill in by the Council demonstrates that you, the producer, and the council as the contractor have taken reasonable steps to comply with the 'duty of care' obligation.

If we don't receive a completed 'duty of care' form from your business then we cannot offer you a collection service.

Remember

It is illegal to move waste without completing a Duty of Care Transfer Note and you could be liable if someone dumps your waste illegally.
