THE CLACKMANNANSHIRE COUNCIL (HILLFOOTS ROAD, MENSTRIE TO ALVA)  (EXPERIMENTAL PROHIBITION OF VEHICLES) (AMENDMENT NO. 1) ORDER 2020

The Clackmannanshire Council has made the above named Order under Sections 9 and 10 of the Road Traffic Regulation Act 1984 (as amended) and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to said Act and having complied with the statutory requirements of The Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999, on 10 December 2020.

The Experimental Order is required for the purpose of road safety and to encourage active travel.

This Order makes it unlawful for any person to drive or cause or permit to be driven any motor vehicle, except authorised vehicles, at any time during the period from 0800 hours on Monday 28 December 2020 for a maximum period of up to 18 months, on the section of road described in the Schedule.  Exemptions being:

  1. Where construction vehicles are being used in connection with the removal of any obstruction to traffic, the maintenance improvement or reconstruction of any of the lengths of road so referred to, or the laying, erection, alteration or repair in or near to the said lengths of road of any sewer or main, pipe or apparatus for the supply of gas, water or electricity or any telecommunications apparatus as defined in subparagraph 1(1) of Schedule 2 to the Telecommunications Act.
  2. Where the vehicle is used for police, fire brigade or ambulance purposes or any vehicle in the service of the local authority in either case being used in pursuance of statutory power or duties.
  3. Where the vehicle is being used by a medical practitioner visiting patients on professional calls when such a vehicle bears, in a conspicuous position, the appropriate identification badge.
  4. For essential deliveries to adjacent properties, which due to vehicle size, are unable to gain access by another route.

From a point 6 metres east of the access road to Mairtoun Hill Steading in an easterly direction to a point 160 metres west of the vehicular access to Myretoun Cottage a distance of 320 metres or thereby.
