Court finds in Council's favour

Clackmannanshire Council's health and safety record has been upheld by Alloa Sheriff Court.

A Sheriff has found in favour of the Council after an employee attempted to claim damages from his employer.

The employee, a painter, had fallen down around 6 stairs while painting the exterior of a house in Alloa.

In his ruling, Sheriff Derek O'Carroll, states: "...although there was a risk of the Pursuer falling, and he did fall and injure himself, the defenders did not fail in their duty to take suitable and sufficient measures to prevent, so far as reasonably practicable, the pursuer falling a distance liable to cause personal injury."

Costs were also awarded in the Council's favour.
