In 2009, the Council adopted a Scheme of Delegation for planning application decision making. In accordance with legislation, the Scheme was reviewed in late 2013, and Scottish Ministers have now approved the Scheme for adoption. This means that the majority of applications submitted to the Council for approval are determined by an Appointed Officer of the Council. The applications that will be decided by members of the Council will be:

  • Applications for a national or major development as defined in the Hierarchy of Developments. For example,this would involve a proposal for 50 or more houses.
  • Proposals by the Council or for development of land in which the Council has a financial, land ownership or other interest, which are contrary to the Development Plan or subject to one or more representations against the proposal.
  • Any application by a member of the Council, which is contrary to the Development Plan or subject to one or more representations against the proposal.
  • Applications which would normally have been decided by the Appointed Officer but have been "called in" for a Planning Committee decision by one or more Elected Members of the Council.

The implementation of the Scheme of Delegation should mean that our management arrangements are fit for purpose and the Council can continue to build on its excellent performance on the speed of decision making on applications, without compromising the other Scottish Government objectives of inclusion and sustainability.
