Marchglen Enforcement Action

Clackmannanshire Council is delighted to have finally secured the co-operation of the owner to comply with an enforcement notice against unauthorised development in a field in Marchglen.

The Council first became aware of this unauthorised development in May 2010 when caravans were stationed in the field over a holiday weekend and immediately served a stop notice to prevent further intrusion, followed by an enforcement notice.

A number of actions and procedures, including a planning application and appeals, followed as the owners tried to regularise the unauthorised activity before the Council could press to have the breach of planning control remedied.

Councillor Donald Balsillie, Enterprise and Environment Committee Convenor, said: "Substantial works were carried out in this field at Marchglen to create a residential pitch for static caravans, occupied by travelling people and involving altering levels, new access arrangements, fencing and associated outbuildings and services, all of which were developed without planning permission."

Councillor Alastair Campbell, Planning Committee Convenor added: "Our officers carried out months of informal communication with various representative parties including the Scottish Government, Planning Aid for Scotland and local residents in Marchglen to seek to solve the planning issues and bring the matter to a satisfactory conclusion."

The caravans were removed from the site in July 2012 and since then all the remaining fixtures and waste including a stable and fences have been removed. The land has also been reinstated, to return the site to its original condition.
