Application for a Certificate of Lawfulness
It is often necessary when purchasing land or a business for the use and or development of the land may continue to operate or be constructed lawfully under the provision of the Planning Legislation and Council’s Development Plan.
To ascertain whether an exiting use of a building or land may continue to operate lawfully, or whether a proposed use or development is lawful a Certificate of Lawfulness is required.
Any person may apply for a certificate provided the necessary information is supplied to Council with the relevant application form and fee paid.
Your Certificate if issued, will:
- specify the land to which it relates;
- describe the use, operations or other matter in question (in the case of any use falling within one of the classes specified in an order under section 26(2)(f), identifying it by reference to that class);
- give the reasons for determining the use, operations or other thing to be lawful; and
- specify the date of the application for the certificate.
