Council Tax Arrears Action

Clackmannanshire Council has a duty to pursue all Council Tax arrears.

Reminder letters are issued to all residents who have arrears unless a current payment arrangement is in place. Failure to make a payment agreement on receipt of these reminders will see the arrears recovered via summary warrant proceedings. If this happens then you will be contacted by Stirling Park (Tel: 01259 404204) who are our Sheriff Officers who have been instructed to proceed on our behalf.

If you think that you have unpaid Council Tax arrears please contact us to make an arrangement using the details at the bottom of this page.

You need to pay your Council Tax bill by instalments by the due dates stated on your bill. If you miss one full instalment you will fall into arrears and you will have to bring your account up to date within 7 days of being asked. You will only be reminded twice.

If you fail to bring your instalments up to date you will lose the right to pay by instalments and you will then be liable to pay the outstanding balance in full.

Please note you will not have another chance to pay by instalments and no further reminders will be sent.

Any unpaid arrears are recoverable by Summary Warrant proceedings with the addition of a 10% penalty.

Court action can lead to:

  • you being asked for details of your employment and bank accounts;
  • your earnings being arrested;
  • your bank account being arrested;
  • the Sheriff Officer being involved in the recovery process;
  • deductions being made from your Income Support.

Water Direct

From March 2020 the council will be adopting the Water Direct Scheme to collect Water and Sewerage debt for households in receipt of Council Tax Reduction.

This scheme will see Clackmannanshire Council apply to the DWP on the failure to pay water and sewerage charges when a final reminder has been issued.

If the application is successful a deduction equal to the ongoing weekly water and sewerage charge and any arrears up to March 2020 will be deducted from your benefit. If you have arrears for earlier financial years the standard Council Tax Deduction could also continue.

The application doesn’t require your consent and Clackmannanshire Council are not required to apply for a summary warrant meaning that no 10% cost is incurred.
